Welcome to SoekTog.co.za (“SoekTog”, “we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, accounts, listing packages, and related services that enable users to create and browse business and community listings, and contact listing owners through embedded forms.
By accessing or using SoekTog, creating an account, purchasing a listing package, or submitting a listing, you agree to be legally bound by these Terms, our Privacy Policy, and any service-specific policies or notices. If you do not agree, do not use the website or services.
Definitions and interpretation
- “User” / “you” / “your”: Any person or entity accessing the website, creating an account, purchasing packages, or submitting listings.
- “Listing Owner”: A user who purchases a listing package and submits listings.
- “Visitor”: A user who browses listings without purchasing packages.
- “Listing”: User-submitted content promoting a business, service, event, job vacancy, property, accommodation, or similar.
- “Package(s)”: Paid services enabling listing submissions, enhancements, and durations.
- “Services”: All functionality provided by SoekTog, including accounts, purchasing, listing submission, browsing, and contact forms.
- “Content”: Any text, images, video, audio, data, links, or other materials submitted, uploaded, or displayed on SoekTog.
- “Applicable law”: South African law including, without limitation, the Electronic Communications and Transactions Act (ECTA), Consumer Protection Act (CPA), Protection of Personal Information Act (POPIA), Copyright Act, Trade Marks Act, and any other binding legislation and regulations, as well as relevant international standards where applicable.
Unless the context indicates otherwise, words importing the singular include the plural and vice versa.
Acceptance of terms
- Binding agreement: Your use of any part of SoekTog constitutes acceptance of these Terms and the Privacy Policy.
- Capacity and authority: You warrant you are at least 18 years of age or are duly authorized by a legal guardian or representative; and, for entities, you warrant you have authority to bind the entity.
- Updates: We may amend these Terms at any time. Changes take effect when posted. Continued use after changes constitutes acceptance.
- Separate agreements: Specific packages or promotions may have additional terms. If there is a conflict, the more specific written agreement governs that service.
Services provided
- Directory platform: SoekTog is a digital business portal/guide/directory that enables listing owners to publish listings (e.g., businesses, restaurants, bars, events, houses for sale, job vacancies, houses to rent, accommodation) and enables visitors to browse and contact listing owners via hosted forms.
- Facilitation only: We are an intermediary platform. We do not buy, sell, broker, rent, manage, or guarantee the goods, services, properties, jobs, or events advertised in listings. We are not party to transactions between users and listing owners, and we do not verify or endorse listings unless explicitly stated in writing.
- Availability: We strive for reliable access but do not guarantee continuous, uninterrupted, or error-free operation. Maintenance, upgrades, outages, and third-party provider issues may occur.
User accounts and access
- Registration: You must provide accurate, complete information during account creation and keep it updated.
- Security: You are responsible for safeguarding your login credentials and restricting access to your account. Notify us promptly of unauthorized access.
- Account actions: We may suspend, restrict, or terminate accounts for violations of these Terms, suspected fraud, abusive behavior, or legal/regulatory requirements.
- One account policy: You may not create multiple accounts to circumvent package limits, pricing, or sanctions.
Listing packages, pricing, and billing
- Packages: Listing packages define permitted listing types, quantities, features, add-ons, duration, renewal rules, and fees. Package details are disclosed at purchase.
- Recurring billing: Some packages may auto-renew (e.g., monthly or annually). You authorize recurring charges until you cancel. Cancellation takes effect at the end of the current paid term unless otherwise specified at purchase.
- Payment methods: Accepted methods may include EFT and online payments through third-party processors. You agree to their terms and privacy policies.
- Taxes: Prices may exclude applicable taxes and fees. You are responsible for any VAT or other applicable taxes unless stated otherwise.
- Invoices and receipts: We issue electronic invoices/receipts. Keep your contact and billing details current to ensure delivery.
- Price changes: We may update prices, package features, or terms with notice on the website. Changes apply to future billing cycles or new purchases.
Refunds, cancellations, and chargebacks
- Listing packages: Unless mandated by the CPA, fees for packages are non‑refundable once activated or delivered (including setup or publication), as services begin immediately.
- Auto‑renewals: Refunds for auto‑renewals are generally not provided once a cycle is billed. You can cancel prior to renewal to avoid future charges.
- Discretionary refunds: We may consider partial or full refunds at our sole discretion in cases of non‑delivery of a paid package feature explicitly promised in writing.
- Chargebacks: You agree not to make fraudulent or abusive chargebacks. We may contest chargebacks, suspend your account, remove listings, and pursue recovery of fees and costs where appropriate.
Listing submission and content rules
- Accuracy and legality: You must ensure your listings are accurate, up-to-date, lawful, and compliant with all applicable regulations (including consumer protection, advertising standards, employment laws, property and rental laws, liquor licensing, health and safety, and municipal bylaws).
- Prohibited content: You may not submit content that is illegal, misleading, discriminatory, defamatory, obscene, pornographic, incites violence, promotes hate, infringes intellectual property or privacy rights, or contains malware or malicious code.
- No unauthorized claims: You may not make unverifiable claims (e.g., “best price guaranteed” without substantiation), impersonate third parties, or misrepresent affiliations.
- Links and tracking: External links must be safe and relevant. We may use tracking or analytics on listing pages and contact forms.
- Contact forms: Messages sent through listing contact forms are forwarded to listing owners or their designated recipients. We may log and moderate messages for abuse prevention and compliance.
- Moderation and removal: We may edit, refuse, or remove content, listings, or reviews at our sole discretion for violations, suspected fraud, poor quality, or risk management, without refund.
- Review/ratings: If enabled, reviews must be genuine and respectful. We may remove reviews that violate these Terms or applicable law.
Intellectual property and licenses
- User content license: By submitting content, you grant SoekTog a non‑exclusive, worldwide, royalty‑free license to host, store, reproduce, display, distribute, and promote the content in connection with operating and marketing the platform, including derivative works necessary for technical functionality (e.g., resizing images). You warrant you have all rights necessary to grant this license.
- Trademarks and branding: SoekTog trademarks, logos, and branding may not be used without our express written consent.
- Website IP: All software, design, databases, look-and-feel, and compilations are owned or licensed by SoekTog and protected by law. No rights are granted except as expressly stated.
- Takedown: If you believe content infringes your rights, notify us with sufficient detail (rights claimed, location of content, proof of ownership, contact details). We may remove or disable access while assessing the claim.
User responsibilities and compliance
- Legal compliance: You must comply with applicable South African and international laws, including advertising, consumer protection, employment, property, rental, liquor, health, and data protection requirements.
- Business legitimacy: Listing owners warrant they have all licenses, permits, and authorizations required to operate their business and advertise their offerings.
- Fair dealing: You must not misuse the platform, spam users, scrape data, reverse engineer, circumvent security, or engage in denial‑of‑service or similar acts.
- Third‑party rights: You are solely responsible for obtaining consent for third‑party content (e.g., images, logos, trademarks) used in listings.
Platform role, independence, and disclaimers on transactions
- No agency: We are not an agent, broker, insurer, escrow, or legal representative of listing owners or visitors.
- No guarantees: We do not guarantee the availability, quality, safety, legality, pricing, or suitability of any listing, nor the accuracy or completeness of content.
- Independent parties: Any interaction, communication, purchase, rental, job application, booking, or arrangement arising from a listing is solely between the visitor and listing owner. You assume all risks associated with such interactions.
Service availability, maintenance, and changes
- Uptime: While we strive for uptime, we may perform routine or emergency maintenance and rely on third‑party infrastructure (hosting, payments, email, analytics). Interruptions may occur.
- Feature changes: We may modify, suspend, or discontinue features, packages, or tools at any time. Where feasible, we will provide notice of material changes that affect paid services.
Data protection and privacy
- POPIA compliance: We process personal information in accordance with POPIA and our Privacy Policy. We collect and process data relevant to accounts, purchases, listings, and contact forms.
- Processing bases: We rely on lawful bases including consent, contract performance, legitimate interests (fraud prevention, service improvement), and legal obligations.
- Security: We implement reasonable technical and organizational measures to protect personal information, but no system is entirely secure.
- Third‑party processors: We may share data with service providers (e.g., payment gateways, email services, analytics) subject to appropriate safeguards.
- User obligations: You must ensure that any personal information you submit (including for employees, applicants, tenants, or customers) is collected lawfully, with necessary consents or notices.
- Data subject rights: Users may exercise rights of access, correction, deletion, or objection as described in the Privacy Policy.
External links and third‑party services
- Third‑party terms: The website may link to or integrate third‑party services (payment gateways, social platforms, plugins). We are not responsible for their content, policies, or availability.

- Content reliance: Information in listings may be outdated or inaccurate. You should independently verify critical information before acting.
Limitation of liability
- Maximum extent: To the fullest extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages; loss of profits, revenue, business, goodwill, data; or reputational harm arising from or related to the website or services.
- Cap on liability: Our total liability for any claim is limited to the amount you paid to us for the specific package giving rise to the claim in the 3 months preceding the event.
- No liability for user actions: We are not responsible for acts, omissions, representations, or negligence of users, listing owners, or third‑party service providers, nor for content posted by users.
- Mandatory rights: Nothing in these Terms limits rights or remedies that cannot be excluded under the CPA or other mandatory law.
Indemnity
- Your indemnification: You indemnify, defend, and hold harmless SoekTog, its owners, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Breach: Your breach of these Terms or applicable law.
- Content: Your content or listings, including IP infringement, defamation, or privacy violations.
- Transactions: Your dealings with visitors, customers, tenants, job applicants, or any third party.
- Misuse: Your misuse of the website or services.
Suspension and termination
- Our rights: We may suspend or terminate access, remove listings, or disable features without notice if you breach these Terms, engage in unlawful or harmful conduct, or create risk to users or the platform.
- Your termination: You may terminate your account or cancel auto‑renewing packages via your dashboard. Termination or cancellation does not entitle you to refunds for already‑delivered services unless required by law or agreed in writing.
- Post‑termination: Certain clauses survive termination, including IP, indemnity, limitations of liability, and governing law.
Compliance with consumer protection (CPA)
- Disclosure: We aim to provide clear package descriptions, pricing, renewal terms, and cancellation mechanisms.
- Cooling‑off: Where ECTA or CPA provides a cooling‑off period for certain electronic transactions, we will honor it unless the service has begun with your prior consent and acknowledgment of immediate performance (which may limit the cooling‑off right).
- Unfair terms: Nothing herein is intended to be unfair, unreasonable, or unjust under the CPA. If a clause is found unenforceable, the remainder remains in effect.
Notices, communications, and records
- Electronic communications: You consent to receiving notices, invoices, receipts, and communications electronically.
- Service of notices: Formal legal notices must be sent to our designated email and physical address (once provided in our Contact section).
- Records: Electronic records, logs, and system data maintained by us constitute prima facie evidence of transactions and communications.
Dispute resolution
- Good‑faith resolution: Parties should first seek to resolve disputes through good‑faith discussions within 10 business days of written notice.
- Mediation/Arbitration: If unresolved, disputes may be referred to mediation and, failing that, arbitration under the rules of the Arbitration Foundation of Southern Africa (AFSA), seated in South Africa, with proceedings in English. Costs may be allocated by the arbitrator.
- Court recourse: We may seek injunctive relief or urgent relief in a competent South African court to protect intellectual property, confidentiality, or platform integrity.
Governing law and jurisdiction
- Law: These Terms are governed by the laws of the Republic of South Africa.
- Jurisdiction: Subject to the dispute resolution clause, you consent to the non‑exclusive jurisdiction of competent South African courts for any proceedings arising from these Terms.
Force majeure
- Events: We are not liable for delays or failures due to events beyond our reasonable control, including natural disasters, pandemics, acts of government, labor disputes, power failures, network disruptions, cyberattacks, or third‑party service outages.
- Mitigation: We will take reasonable steps to mitigate and resume performance when feasible.
Assignment and transfer
- Our rights: We may assign or transfer our rights and obligations under these Terms to an affiliate or acquirer as part of a reorganization, merger, or sale.
- Your rights: You may not assign your rights or obligations without our prior written consent.
Severability and entire agreement
- Severability: If any provision is unenforceable, it will be modified to the minimum extent necessary to be enforceable, and the remainder will continue in full force.
- Entire agreement: These Terms, together with the Privacy Policy and any package‑specific terms, constitute the entire agreement between you and us regarding the Services.

- Complaint handling: Provide a process and expected timeline for handling user complaints and takedown requests.
